How much can you get fined for commercial waste disposal?

Legally disposing of commercial waste through an efficient waste management service guarantees they will always dispose of controlled waste safely and many types of waste will be recycled.

Every business is legally responsible to ensure that any waste they produce is handled safely and within the law. Both district and borough councils, plus several other agencies including the Environment Agency, take environmental crime very seriously and will seek prosecution in instances where businesses are found to be disposing of waste illegally. Another instance where unlimited fines will be issued is if a business was to breach the ‘Duty of Care’ Act of Section 34 of The Environmental Protection Act 1990. Duty of care waste regulations apply to businesses that import, produce, carry, keep, treat, dispose of or, as a dealer or broker have control of, certain waste in England or Wales.

It is an offence to dispose of business or commercially generated waste at local a recycling centre and councils will investigate any such incidents of misuse.

Household Waste Recycling Centres (HWRCs) are provided for residents for the disposal of their domestic waste only. Each district council will have several Waste Transfer Stations, generally co-located with a HWRC, where businesses can take commercial waste/trade waste for disposal.  

There is a charge for this service, with each Waste Transfer Station being operated by a third-party contractor who are responsible for setting their own costs which is based on the amount (weight) of waste being disposed. Note that some WTS have restrictions on who can dispose of business waste at their site, and that all businesses must create waste transfer notes for each load of waste that leaves their site.  

Never hand your waste over to a company for disposal without making the proper checks. You never know where your waste may end up.

Now employees are working from home, any work-related waste they produce is technically ‘commercial’ and should be a consideration for the business owner.  This is especially relevant to those dealing with confidential documents, as improper disposal will breach the Data Protection Act which regulates the collecting, storing, and destroying of any data deemed confidential.

- They keep records to prove they have been operating legally
